Status - Mifepristone Ruled Illegal in Texas

Medication abortions make up 53% of all abortions. Mifepristone is used in combination a second drug Misoprostol for safe and effective abortion. Mifepristone has been used safely and effectively for 23 years in the US and for far longer in Europe. Abortion can still be accomplished with Misoprostol but the process is far more painful.

It is also important to note that Mifepristone is used to induce labor, for miscarriage management, to preserve the mother’s life and fertility, and for Cushing’s disease.

Friday April 8th, 2023 Trump appointed federal judge Kaczmaryk has ruled the safe and effective abortion care medication Mifepristone illegal in the US. The argument against the FDA process and the medication was that the FDA rushed to approve it. If fact, the approval process used took 54 months whereas usual drug reviews require about 15 months.

It is interesting to note that Judge Kacsmaryk was not an impartial judge in the matter but had indicated that he would do everything possible to make abortion illegal before this case was even brought. This bias going in to the case and choice not to recuse himself because of bias is judicial misconduct and is worthy of impeachment as is his refusal to r teview scientific safety data makes him worthy of impeachment. Judges are supposed to be impartial in their application of the law, not a proponent for one side or the other. Kacsmaryk is basing his unprecedented decision on his own right-wing religious views, deep partisanship, and personal crusade against abortion access. These are not how our freedoms can be treated. Let me point out here that this technique of overstepping the authority Congress allocated, in law, to the FDA, if it stands, could be used to make vaccines and other medications illegal nation wide as well. The authority of the FDA must remain in place as Congress intended.

There have been calls to ask Congress to make Mifepristone legal to use by a special legislation. It is a knee jerk reaction and I don’t recommend it since it would be another bypass of the FDA regulations that have been established in law by Congress. The FDA’s authority to determine the safety and efficacy of medications for the US population must not be bypassed. Also, if you put such a law in place, sometime in the future it could be overturned.

Women’s Health Protection Act (WHPA)

One thing that is important that Congress approve is the the Women’s Health Protection Act which would protect the right to an abortion, nationwide, and the right to travel to obtain one without interference.

US TALIBAN in Action

This is the political part of today’s note. Republicans are pushing for more access to guns without controls, banning books, limiting what can be taught in school and are allocating women and girls to 2nd class citizens. Pretty much what the Taliban has been putting in place in Afghanistan - one of the most anti democratic places on earth.

Standing between a woman and the doctor she chose for medical advice, relegates her to less than personhood. We need to pass the Equal Rights Amendment Now. This amendment to the US constitution is the only one to have had a deadline for passage. The requisite 38 states have ratified it. Now it is up to Congress to extend the deadline. Urge them to do it right now. The women and girls of this country deserve to see equality enshrined in our Constitution.
